Q: How long will it take to get divorced?
A: The paperwork and mediation for your Marital Settlement Agreement is usually done within thirty days of when you start the divorce. Marital Status usually ends six months and one day after the day that the Respondent receives a copy of the Divorce petition. Sometimes the process drags on because parties fail to cooperate or lawyer-up.
Q: Can we get a divorce if only one of us wants one?
A: Yes. But the other may slow the process by being uncooperative, asking for continuances or raising additional issues. In general, judges prefer agreements to court orders and will encourage a couple to negotiate an agreement before trial. Ultimately, the judge will grant the divorce. Sage Stones can process a divorce like this and minimize court appearances. We will write a Marital Settlement Agreement with you as the source of what seems fair and equitable and you can submit it to the court as a "Proposed Judgment". We provide all the legal paperwork as well.

Q: What is a Marital Settlement Agreement?
A: It�s a contract between a divorcing couple that settles issues such as a division of community property and debts, and lists your agreements regarding ongoing concerns, such as child support, spousal support, parenting times, medical coverage, shared costs of raising the kids not covered by child support, etc. Once you�ve reached an agreement on every issue, the Marital Settlement Agreement is filed with the court and becomes your judgment.
Q: How much Guidance can we expect from Sage Stones?
A: Often, mediation opinions and legal advice appear similar because both are based on fair and equitable solutions for family problems. However, legal advice must come from one trained in interpreting the technical points that legal decisions stand upon. A: Yes. We can mediate and your attorney can remain your advisor and attorney of record. Or, one or both of you can release your attorney/s and we�ll mediate your Marital Settlement Agreement and our licensed L.D.A. will finish your paperwork. That will save you money, reduce conflict and speed things along.
